AirsoftHQ (airsofthq.app) is a price comparison and community platform for airsofters. We consider the protection of your personal data important. In this privacy policy we explain which personal data we process, for what purpose, on what legal basis, with whom we share it and what rights you have. This policy has been drawn up in accordance with the General Data Protection Regulation (GDPR), in particular the information obligation set out in Article 13 GDPR. AirsoftHQ is not a webshop: we do not sell anything ourselves. We compare the offerings of external airsoft shops and refer you to those shops via affiliate links, where you then make your purchase. Therefore, read this policy together with the privacy policy of the shop where you ultimately buy.

1. Who is the data controller?

The data controller for the processing of your personal data via AirsoftHQ is Beflore, trading under the name AirsoftHQ.

Our details are: Beflore, established at Reurikwei 83, 6843 XV Arnhem, registered with the Dutch Chamber of Commerce (KvK) under number 94780765, VAT identification number NL005111873B25.

2. Which personal data do we process, for what purpose and on what legal basis?

We only process the personal data that is necessary for the purposes we describe below. For each purpose we indicate which data we process and on what legal basis (Article 6 GDPR) this takes place.

Creating and managing an account. When you create an account, we process your email address, your chosen password (stored in encrypted form) and your callsign (username). Purpose: to enable you to log in, manage your profile and provide you with a personalised experience. Legal basis: the performance of the user agreement we conclude with you when you create an account (Article 6(1)(b) GDPR).

Squad and team functionality. If you create a squad or team, join one or invite someone, we process your callsign, your team membership, invitations you send or receive, and messages and objectives you share within a squad. Purpose: to enable collaboration and communication between members of a squad. Legal basis: the performance of the agreement (Article 6(1)(b) GDPR) and our legitimate interest in offering a functioning community platform (Article 6(1)(f) GDPR).

Game logging, field reviews and leaderboard. When you record game days (game log), review fields or appear on the leaderboard, we process your callsign, your recorded game activity, your reviews and associated statistics. Purpose: keeping track of your own game history, showing field reviews to the community and compiling a leaderboard. Legal basis: the performance of the agreement (Article 6(1)(b) GDPR) and our legitimate interest in a lively and informative community platform (Article 6(1)(f) GDPR).

Submitting and moderating events. If you submit an event, we process the data you enter and your account identification, so that we can assess and publish the submission. Purpose: managing and moderating events submitted by users. Legal basis: the performance of the agreement (Article 6(1)(b) GDPR) and our legitimate interest in quality control and the prevention of misuse (Article 6(1)(f) GDPR).

Push notifications. If you give consent for push notifications, we process a device token in order to be able to send you notifications. Purpose: informing you about relevant updates, squad activity or events. Legal basis: your consent (Article 6(1)(a) GDPR), which you can withdraw at any time via the settings of your device or your account.

Analytics. With your consent we collect data about how you use AirsoftHQ, such as pages visited, click behaviour and technical data about your device and browser. Purpose: measuring and improving the operation and usability of the platform. Legal basis: your consent (Article 6(1)(a) GDPR).

Marketing. With your consent we may show or send you personalised offers, newsletters or recommendations. Purpose: informing you about offers and news relevant to you. Legal basis: your consent (Article 6(1)(a) GDPR), which you can withdraw at any time.

Affiliate tracking. AirsoftHQ earns a commission when you buy something from an external shop via a link on our platform. In order to be able to attribute those purchases to us, data is processed via affiliate networks, such as a click identifier, the time of your click and (by the affiliate network) whether a purchase has taken place. Purpose: correctly attributing commissions and measuring the effectiveness of our referrals. Legal basis: your consent for placing the tracking required for this (Article 6(1)(a) GDPR) and, to the extent permitted, our legitimate interest in a functioning revenue model (Article 6(1)(f) GDPR).

3. Are you obliged to provide your data?

You are not obliged to provide personal data to us. You can use AirsoftHQ largely without creating an account.

However, some features only work if you provide certain data. For example, you need an email address and callsign to create an account, and you cannot use squad features or submit events without an account. If you do not provide this data, you cannot use those specific features.

4. Recipients and processors

We never sell your personal data. We only share your data with parties that help us provide AirsoftHQ, and only for the purposes stated in this policy. With parties that process personal data on our behalf, we conclude data processing agreements in accordance with Article 28 GDPR.

Supabase: our hosting partner for the database and the account system (authentication). This is where, among other things, your account, squad, game log, review and event data are stored.

Netlify: our hosting partner for the website and application. When visiting the platform, technical data such as your IP address is processed in order to deliver and secure the site.

OpenStreetMap: for displaying maps and map tiles. When loading a map, your IP address and technical device information may be sent to the map service.

Microsoft 365 (email): for our email communication with you, for example if you contact us.

Affiliate networks: the networks and partner shops we work with receive, via affiliate links, the data needed to attribute your purchases to us.

In addition, we may provide data to competent authorities where we are legally required to do so. Some of the parties mentioned above are independent data controllers for the processing they carry out for their own purposes; for that, consult their own privacy statements.

5. Transfer outside the EEA

We strive to process your personal data within the European Economic Area (EEA). Some of the service providers mentioned above, in particular Microsoft and certain affiliate networks, may (partly) process data outside the EEA, for example in the United States.

When data is processed outside the EEA, we provide appropriate safeguards as referred to in the GDPR. As a rule, this is done on the basis of the Standard Contractual Clauses (SCCs) adopted by the European Commission, supplemented where necessary with additional measures, or on the basis of an adequacy decision of the European Commission.

6. How long do we retain your data?

We do not retain your personal data longer than is necessary for the purposes for which it was collected, or than is legally required.

We retain account data for as long as your account is active. When you delete your account, we delete or anonymise your account data within a reasonable period, except for data that we are legally required to retain longer.

We retain squad, game log, review and event data for as long as is necessary for the operation of the community and the functioning of your account; upon deletion of your account, this data is deleted or disconnected from your identity.

Data that we process on the basis of your consent (such as analytics, marketing and certain tracking) we retain until you withdraw your consent, and thereafter no longer than necessary.

For administrative and tax data, the statutory retention obligation applies (in the Netherlands, in principle, seven years).

7. How do we secure your data?

We take appropriate technical and organisational measures to protect your personal data against loss and against unlawful processing. Think of encrypted connections (HTTPS), encrypted storage of passwords, access restrictions and careful selection of our service providers.

Should a data breach nevertheless occur despite our measures, we act in accordance with our legal obligations and, where necessary, inform the Dutch Data Protection Authority (Autoriteit Persoonsgegevens) and the data subjects.

8. Your rights

Under the GDPR you have a number of rights regarding your personal data. You can exercise these rights by contacting us at info@airsofthq.app.

Right of access: you may request which personal data we process about you.

Right to rectification: you may have incorrect or incomplete data corrected or supplemented.

Right to erasure (to be forgotten): in a number of cases you may ask us to delete your data.

Right to restriction of processing: in certain cases you may ask us to temporarily restrict the use of your data.

Right to object: you may object to processing that we base on a legitimate interest, and at all times to the use of your data for direct marketing.

Right to data portability: you may receive or have transferred the data that you yourself have provided to us and that we process on the basis of consent or the agreement, in a common, structured and machine-readable format.

Right to withdraw consent: where we process your data on the basis of consent, you may withdraw that consent at any time. The withdrawal does not affect the lawfulness of the processing prior to the withdrawal.

In principle, we respond to your request within one month. To prevent misuse, we may ask you to identify yourself before we comply with your request.

9. Right to lodge a complaint with the supervisory authority

If you disagree with the way we handle your personal data, we would appreciate it if you first let us know via info@airsofthq.app, so that we can look for a solution together.

In addition, you always have the right to lodge a complaint with the supervisory authority. In the Netherlands this is the Dutch Data Protection Authority (Autoriteit Persoonsgegevens) (www.autoriteitpersoonsgegevens.nl). If you live in another country within the EEA, you can lodge a complaint with the supervisory authority in your own country.

10. Minors

In many countries airsoft has a minimum age for participation, and online there are also age limits for the processing of personal data.

We only process personal data of persons under 16 years of age if consent has been given for this by a parent or legal representative. In countries where a higher age limit applies, we apply that higher limit.

If you are under 16 years of age (or under the age limit applicable in your country, up to a maximum of 18 years), only create an account with the consent and under the supervision of your parent or guardian. If we suspect that we have collected data of a minor without the required consent, we delete that data as soon as possible. Parents and guardians can contact us about this via info@airsofthq.app.

11. Cookies and similar techniques

AirsoftHQ uses cookies and similar techniques that are necessary to make the platform function, and in addition cookies and techniques for analytics, marketing and affiliate tracking.

For the non-necessary cookies and techniques, we ask for your consent in advance. You can adjust or withdraw your preferences at any time. You can find more information about this in our cookie policy, to the extent applicable.

12. Changes to this privacy policy

We may amend this privacy policy from time to time, for example if our services, the parties used or the laws and regulations change.

You can always find the most current version at airsofthq.app. In the event of important changes that affect you, we will inform you where appropriate. We recommend that you consult this policy regularly.
