Welcome to AirsoftHQ. These terms of use describe the rules that apply when you use the AirsoftHQ website and app (airsofthq.app), hereinafter together referred to as "the Platform". AirsoftHQ is provided by Beflore, registered with the Dutch Chamber of Commerce (KvK) under number 94780765, VAT identification number NL005111873B25, established at Reurikwei 83, 6843 XV Arnhem (hereinafter: "we", "us" or "AirsoftHQ"). By accessing or using the Platform, you agree to these terms. Please read them carefully. If you do not agree with them, do not use the Platform. AirsoftHQ is aimed at users in the Netherlands, Belgium and the rest of the European Union, and additionally at the United Kingdom and the United States.

1. Nature of the service: information and comparison platform, not a seller

AirsoftHQ is an independent information and price comparison platform for airsoft products and related items. We collect, organize and display product information, prices, availability and links to external web shops, and we additionally offer tools such as a product catalogue, a gear manager, map and playing field features and knowledge articles.

AirsoftHQ does not sell any products itself and is not a web shop. We hold no stock, ship nothing and process no payments for products. We are expressly not a party to any purchase agreement that you conclude. If you follow a link on the Platform to an external web shop and place an order there, the purchase agreement is concluded exclusively between you and that web shop.

Your order, payment, delivery, warranty, returns, complaints and all other rights and obligations are governed by the terms and the (consumer) policy of the web shop in question. We have no influence over, and are not responsible for, the handling thereof. Any questions or disputes regarding a purchase must be resolved directly with the web shop.

2. Price and stock disclaimer

The prices, availability, product characteristics, images and other data displayed on the Platform are, for the most part, automatically collected from external web shops and other third-party sources. This data is updated periodically, but at the moment you view it, it may be outdated, incomplete or incorrect.

The price displayed on the Platform is therefore always indicative and not binding. Only the price, the stock and the product information as stated by the external web shop itself at the time of ordering are decisive and binding. Always check the current data on the web shop's website before making a purchase.

We strive to provide a display that is as correct and up to date as possible, but we cannot guarantee that the data displayed is complete, accurate or up to date. No rights can be derived from obvious errors, mistakes or clerical errors in the information displayed.

3. Affiliate relationship

Some links on the Platform are affiliate links. This means that when you follow such a link to a web shop and make a purchase there (within a certain period), we may receive a fee or commission from that web shop or from an intermediary affiliate network.

This fee is paid by the web shop and has no effect on the price you pay: by using an affiliate link, you pay no more than you would if you went to the web shop directly. The commission is part of the web shop's margin, not a surcharge for you.

We strive for an independent and fair presentation and comparison. Whether or not an affiliate relationship exists with a particular web shop does not determine which products or prices we display or how we rank them. Affiliate income (partly) covers the costs of operating and further developing the Platform.

4. No warranties

The Platform and all information and features offered on it are provided in the condition in which they are found ("as is" and "as available"). To the extent permitted by law, we give no warranty whatsoever as to the accuracy, completeness, timeliness, availability, reliability or fitness for a particular purpose of the Platform or the data displayed.

We do not warrant that the Platform operates uninterrupted, error-free or free of viruses or other harmful elements, nor that defects will be remedied. We may modify, temporarily suspend or terminate the Platform or parts thereof at any time, for example for maintenance, without being liable for doing so.

Features such as maps, location, distance and ballistic calculations, playing field and event data, and gear overviews are intended as a tool and an indication. For decisions that affect your safety or that of others, never rely solely on these tools, but use your own judgement and verify the data on site.

5. Limitation of liability

To the extent permitted by law, AirsoftHQ is not liable for damage arising from or in connection with the use of (or the inability to use) the Platform, reliance on the information displayed, incorrect or outdated price or stock data, or transactions you enter into with external web shops or other third parties.

This limitation applies in particular to indirect damage, consequential damage, lost profits, lost savings and damage caused by the unavailability of the Platform or by errors in third-party data.

Nothing in these terms excludes or limits our liability to the extent that this is not permitted under mandatory law. We do not exclude our liability for damage resulting from intent or wilful recklessness on the part of AirsoftHQ, nor for other cases in which exclusion or limitation is not permitted by law.

As a consumer, you always retain your mandatory-law protection. Provisions in these terms that would be unreasonably onerous towards consumers under the Dutch Civil Code (including BW art. 6:236 and 6:237) shall not apply towards consumers; for the rest, the terms shall remain in force as far as possible. To the extent that we are in fact liable by law, our liability is limited to compensation for direct damage and, to the extent permitted, to a reasonable amount.

6. Intellectual property

All intellectual property rights to the Platform and to the content offered on it that originates from us, such as the design, layout, software, texts, compiled overviews, databases, logos and the AirsoftHQ brand, belong to us or to our licensors.

You are permitted to use the Platform for your own, non-commercial use. Without our prior written consent, you may not reproduce, publish, (re)distribute, exploit or automatically read out (scrape) the content in whole or in part, except to the extent that mandatory law permits this.

Product names, brands, images and logos of web shops and manufacturers are the property of their respective rights holders and are used solely for identification and information purposes. No right or involvement of those parties in AirsoftHQ can be derived from this use.

7. External links

The Platform contains links to third-party websites and services, including external web shops and map and knowledge sources. These links are provided solely for information purposes and for your convenience.

We have no control over, and are not responsible for, the content, the offerings, the prices, the privacy policy, the availability or the working methods of those third-party websites. Visiting and using external websites is at your own risk and is subject to the terms and policies of those third parties.

The inclusion of a link does not mean that we recommend or endorse the website in question or the products or services offered on it.

8. Accounts and user conduct

For certain features you can create an account. You are yourself responsible for the accuracy of your data and for keeping your login details confidential. Activities that take place via your account are for your account. If you suspect misuse, report this to us as soon as possible.

You undertake not to use the Platform in a manner that is contrary to the law, these terms or the rights of others. In particular, it is not permitted to post or share incorrect, misleading, unlawful, offensive or infringing content, to disrupt or circumvent the operation or security of the Platform, to collect data in an automated manner without our consent, or to use the Platform for unlawful or fraudulent purposes.

For content that you post or share yourself (such as profile data, gear or messages), you remain responsible yourself; you warrant that you are entitled to do so. We may remove content that is contrary to these terms or the law and may restrict, suspend or terminate accounts in the event of misuse, to the extent that this is reasonable and permitted by law.

9. Airsoft, age and the buyer's responsibility

Airsoft is a regulated activity. The possession, acquisition, use, transport and having available of airsoft devices and related items are subject to legal rules, including age limits and, depending on the country, permit, registration or membership requirements. These rules differ from country to country and may change.

AirsoftHQ provides information only and sells nothing itself. We do not carry out any age or legality checks for purchases; that check and the sale lie entirely with the web shop in question. You are yourself responsible for ensuring that you meet all legal requirements in your country and region before you acquire, possess or use an airsoft product or related item.

By using the Platform, you confirm that you meet the minimum age and other legal conditions applicable in your country for viewing and acting on the basis of this information. The acquisition and use of products are and remain the buyer's or user's own responsibility and at their own risk. We accept no liability for this, to the extent permitted by law.

10. Applicable law and competent court

These terms and the use of the Platform are governed by Dutch law.

This choice of law does not affect the protection you enjoy as a consumer under mandatory provisions of the law of the country in which you habitually reside, including the mandatory consumer law of the European Union. You may always invoke that mandatory-law protection.

Disputes that we cannot resolve between ourselves may be submitted to the competent court. For consumers, this applies without prejudice to their right to submit a dispute to the court that is competent under mandatory law, and without prejudice to the possibility of submitting a complaint via the European platform for online dispute resolution (ODR).

11. Changes to these terms

We may amend these terms of use from time to time, for example on account of new features, changed working methods or changed laws or regulations. The most current version is always available via the Platform.

In the event of significant changes, we will make an effort to draw your attention to them in an appropriate manner. By continuing to use the Platform after a change, you accept the amended terms. If you do not agree with a change, you must cease using the Platform.
